El valor del precedente jurisprudencial en el Derecho romano y en la tradición romanística

Abstract

Este estudio tiene por objeto analizar desde una perspectiva histórica y jurídica el tema del “precedente jurisprudencial” en el derecho romano desde la doble perspectiva de la Ciencia del Derecho y de los pronunciamientos de los órganos jurisdiccionales, sin perjuicio de la consideración de que los responsa prudentiumson una fuente de producción del derecho. El análisis también se llevará a cabo ofreciendo una visión comparativa tanto de los ordenamientos nacionales entre los siglos XVIII y XIX como de los sistemas jurídicos actuales de Common Law

The aim of this study is to analyse, with a historical and legal perspective, the theme of the “jurisprudential precedent” in the Roman law, with the double perspective of the Science of Law and the judgements of the jurisdictional bodies, notwithstandingthe observation of the fact that the responsa prudentiumrepresent a source of production of law. The analysis will be carried out by offering a comparative overview both on the national legal systems between the 18th and the 19th century and on the current legal system of Common Law
