Abstract
Since the late 1990s, media concentration and media pluralism have generated a strong political debate in Europe, evidenced by numerous resolutions of the European Parliament. In 2018, the European Union adopted its new Audiovisual Media Services Directive to alleviate the dysfunctions in the field of communication. In this context, this article seeks to analyse examples in which European legislation has intervened to improve the standards of information pluralism, starting from the theoretical framework of the Communication Structure. Free competition contributes to democratic quality, which is why we advocate studying the legislative uses of competition policy. The aim is to offer a sample that allows us to gain a concrete understanding of how media competition is regulated at the European level, and to this end, three cases are provided that refer to news and entertainment products. The nature of these cases combines the media dimension with more legal aspects. In conclusion, the cases analysed lead us to consider that the proliferation of measures in the area of competition has not been accompanied by sufficient specific actions for communication, putting media pluralism at risk, despite the growing institutional concern in this respect.
